1. General Provisions and Parties

1.2. Agreement: These Terms & Conditions (the “Terms”) constitute a legally binding agreement between the Seller (SIA EPS) and the Buyer (any physical or legal person placing an order).

1.3. Acceptance: By placing an order through the Store, the Buyer confirms that they have read, understood, and fully agree to these Terms.

2. Ordering, Pricing, and Payment

2.1. Pricing: All prices displayed on the Store are quoted in Euros (€) and include the Value Added Tax (VAT) applicable in the Republic of Latvia (currently 21%), unless explicitly stated otherwise. Delivery costs are calculated separately during the checkout process.

2.2. Order Confirmation: The purchase contract is considered concluded when the Buyer receives electronic confirmation of the order from the Seller.

2.3. Payment: The Buyer can make payments using the methods specified in the Store (e.g., bank transfer, credit card, etc.). The Seller reserves the right to cancel an order if the payment is not received within 5 business days.

2.4. Product Availability: If an ordered product is out of stock, the Seller will inform the Buyer as soon as possible and offer a replacement, a similar product, or a full refund.

3. Delivery

3.1. Delivery Area: We deliver products within Latvia and internationally to countries specified on our website.

3.2. Delivery Costs: Delivery costs depend on the shipping method, destination, and product weight, and are displayed to the Buyer before final checkout.

3.3. Delivery Times: Estimated delivery times are 3-5 business days within Latvia and 5-14 business days internationally. The Seller is not responsible for delays caused by the courier service or unforeseen circumstances.

3.4. Risk Transfer: The risk of loss or damage to the Goods transfers to the Buyer upon delivery to the Buyer or the Buyer’s designated courier/delivery service.

4. Right of Withdrawal and Returns (EU Requirement)

4.1. Right to Withdraw: The Buyer (consumer) has the right to withdraw from the contract and return the Goods within 30 calendar days from the day the Buyer or a third party specified by the Buyer received the Goods.

4.2. Procedure: To exercise the right of withdrawal, the Buyer must clearly notify the Seller (via email to epsriga@gmail.com) and return the goods to the Seller’s address provided.

4.3. Condition of Goods: The returned Goods must be unused, undamaged, and in their original packaging. The Buyer is responsible for maintaining the quality and safety of the Goods during the withdrawal period. If the Goods are used or damaged, the Seller may refuse the return or deduct a fee for loss of value.

4.4. Refunds: The Seller shall refund all payments received from the Buyer, including the cheapest standard delivery costs, within 14 calendar days from the date the Seller receives the Buyer’s withdrawal notification AND has received the returned Goods. The Buyer bears the direct cost of returning the Goods.

4.5. Exceptions: The right of withdrawal does not apply to goods that cannot be returned due to hygiene reasons (e.g., mouthguards if the packaging has been opened).

5. Warranty and Claims

5.1. Statutory Warranty: The Buyer is entitled to statutory warranty rights for Goods that do not conform to the contract (defects) for a period of 24 months from the date of delivery.

An ice hockey stick has a warranty period of 30 days, during which time you, as the customer, are covered for manufacturing defects.

In other words, the warranty does not apply to damage or defects caused by external factors. Examples of external factors in an ice hockey context include when a hockey stick is subject to a blow or shot or is trodden on by a skate. 

An ice hockey stick is a product that is created with advanced technology in a fragile material with the aim of making you a better hockey player. 

An ice hockey stick is designed to be used for passing, shooting and controlling a puck. 

In order for Seller to be able to process a warranty claim or complaint regarding a composite hockey stick, the serial number must still be on the stick, and the stick must not be sprayed/painted.

5.2. Claim Procedure: In the event of a defect, the Buyer must submit a written claim to the Seller (via email) immediately upon discovery of the defect, providing proof of purchase and photographs/description of the defect.

5.3. Remedies: The Buyer has the right to demand repair, exchange, a price reduction, or cancellation of the contract, in accordance with the laws of the Republic of Latvia.

6. Data Processing and Privacy

6.1. The Seller processes personal data in accordance with the EU General Data Protection Regulation (GDPR) and the laws of the Republic of Latvia.

6.2. Detailed information regarding the processing of personal data (collection, purpose, and rights) is available in our separate Privacy Policy document, which is an integral part of these Terms.

7. Disputes and Governing Law

7.1. These Terms are governed by the laws of the Republic of Latvia.

7.2. Any disputes arising from these Terms will be resolved through negotiation. If negotiations fail, the dispute may be submitted to the Consumer Rights Protection Centre (PTAC) in Latvia or to the courts of the Republic of Latvia.
